APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
The general terms and conditions of sale detailed below apply to all orders for products and services placed via this Site (the "Products") with [company name] by any person (the "Customer").
The Customer must read the GTC prior to any order (the "Order"), the GTC being available on the Site.
Gentlemen Farmers Sàrl reserves the right to adapt or modify these GTC at any time. Placing an Order requires the Customer's prior and unconditional acceptance of the GTCS by clicking on the "I have read and accept the general terms and conditions of sale" button.
SITE INFORMATION AND ACCESSIBILITY
www.gentlemenfarmers.ch is an e-commerce site owned and operated by Gentlemen Farmers Sàrl.
The Site is accessible to all users of the Internet network in principle 24/24h, 7/7d, except interruption, programmed or not, by Gentlemen Farmers Sàrl or its providers, for the needs of its maintenance and / or security or case of force majeure (as defined below). Gentlemen Farmers Sàrl shall not be liable for any damages of any kind resulting from the unavailability of the Site.
Gentlemen Farmers Sàrl does not guarantee that the Site will be free of anomalies, errors or bugs, nor that the Site will function without breakdown or interruption. In this regard, Gentlemen Farmers Sàrl may freely determine, at its sole discretion, any period of unavailability of the Site or its content. Gentlemen Farmers Sàrl cannot be held responsible for data transmission, connection or network unavailability problems.
Gentlemen Farmers Sàrl reserves the right to modify the Site for technical or commercial reasons. Where such changes do not materially and adversely affect the conditions under which the services are provided, the Customer may be informed of the changes, but acceptance is not required.
CUSTOMER ACCOUNT
In order to place an Order, the Customer registers on the Site by creating an account containing the Customer's information (the "Account").
Customer Accounts allow the Customer to log in to view and track orders, profile information and registered addresses. Upon login, the details stored in the Account are automatically populated at the checkout page for a faster checkout experience.
When creating an Account, the Customer must ensure the accuracy and completeness of the data he/she provides. It is the Customer's responsibility to keep their personal information up to date at all times. Gentlemen Farmers Sàrl cannot be held responsible for the impossibility of delivering Products in the event of an error in the recipient's contact details.
By registering on the Site, the Customer declares and guarantees Gentlemen Farmers Sàrl that he/she is of legal age and has the legal capacity to contract.
Gentlemen Farmers Sàrl may delete the Customer's Account at any time, for any reason, at its sole discretion.
PRODUCTS
The Products offered for sale are those described on the Site on the day the Customer consults the Site, subject to availability. This information is updated automatically in real time. However, Gentlemen Farmers Sàrl cannot be held responsible for any error in updating, regardless of its origin. In this respect, Gentlemen Farmers Sàrl cannot be held responsible for the cancellation of an Order for a Product due to the exhaustion of stocks.
Gentlemen Farmers Sàrl takes the utmost care in the presentation and description of its Products in order to provide the Customer with the best possible information. However, it is possible that errors may appear on the Site, which the Customer acknowledges and accepts.
Gentlemen Farmers Sàrl does not guarantee the accuracy or security of information transmitted or obtained through the Site.
It is possible that the Customer may receive a part following an Order that was previously returned by another person. Gentlemen Farmers Sàrl only accepts the return of Products that are intact, unopened and undamaged. These three conditions are checked before the returned Products are put back into stock.
ORDERS
The placing of an Order on the Site is subject to compliance with the procedure set up by Gentlemen Farmers Sàrl on the Site, comprising successive stages leading to the validation of the Order.
The Customer may select as many Products as he/she wishes, which will be added to the basket (the "Basket"). The Shopping Cart contains a summary of the Products selected by the Customer, together with their prices and related charges. The Customer is free to modify the Basket before validating the Order. Validation of the Order confirms the Customer's acceptance of the General Terms and Conditions, the Products purchased, their prices and the associated costs.
Gentlemen Farmers Sàrl will send the Customer a confirmation email summarizing the Order (Product(s), price, availability of the Product(s), quantity, etc.). To this end, the Customer formally accepts the use of e-mail for confirmation by Gentlemen Farmers Sàrl of the contents of his/her Order.
In the event of abandonment of the Shopping Cart, the Customer may receive a reminder email in order to finalize the order if desired.
REFUSAL TO PROCESS AN ORDER
Gentlemen Farmers Sàrl reserves the right to withdraw at any time any Product displayed on the Site and to replace or modify any content or information appearing on the Site. Despite Gentlemen Farmers Sàrl's best efforts to satisfy its customers' expectations, Gentlemen Farmers Sàrl may refuse to process an Order after having sent the Customer the confirmation email summarizing the Order.
Gentlemen Farmers Sàrl shall not be liable to the Customer or any third party for the consequences of the removal of a Product from the Site, or the replacement or modification of any content or information appearing on this Site, or the refusal to process an Order after sending the confirmation email summarizing the Order.
Gentlemen Farmers Sàrl also reserves the right to refuse or cancel an Order from a customer with whom it has a dispute over the payment of a previous Order.
PRICES AND PAYMENT TERMS
Prices and VAT are indicated according to the country of order. Delivery charges, customs duties or other taxes will be indicated at the time of payment of the order by having the postal address.
All prices shown are calculated and include the applicable value-added tax.
Gentlemen Farmers Sàrl reserves the right to modify its prices at any time, but the Products will be invoiced on the basis of the prices in force at the time of registration and payment of the Order, subject to availability.
Payment for purchases is made via the secure platform of our payment service provider MOLLIE B.V.
The Customer expressly acknowledges that the communication of his/her credit card number to Gentlemen Farmers Sàrl constitutes authorization to debit his/her Account up to the price of the Products ordered. If necessary, Gentlemen Farmers Sàrl will notify the Customer of the cancellation of the Order due to non-payment by sending an e-mail to the address provided by the Customer when the order was placed.
The data recorded and kept by Gentlemen Farmers Sàrl constitutes proof of the Order and of all sales made. The data recorded by MOLLIE B.V. constitutes proof of any financial transaction between the Client and Gentlemen Farmers Sàrl.
DELIVERY
Deliveries are handled by Swiss Post, or other shippers in the case of deliveries outside Switzerland. The delivery charges applicable to the Order are those mentioned on the Site at the time of the Order.
Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the Customer's home address, that of a natural person of his/her choice or that of a legal entity (delivery to his/her company).
In the event that the Customer is unable to make the Delivery, no reshipment will be made and the Customer will be reimbursed within 30 days of receipt of the Order by Gentlemen Farmers Sàrl.
Gentlemen Farmers Sàrl delivers Orders within 3-7 working days for delivery in Switzerland. This period is counted from the first working day after validation of the Order.
In order for these delivery times to be respected, the Customer must ensure that he/she has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).
Gentlemen Farmers Sàrl cannot be held responsible for delays in delivery that are not of its making or justified by a case of force majeure (as defined below).
If the delivery time is exceeded, the Customer may request the cancellation of the sale and obtain a refund of the sums paid for the Order within a maximum of 30 days of the request. Notwithstanding the foregoing, Gentlemen Farmers Sàrl shall not be held liable for any damages resulting from a delay in delivery, and Gentlemen Farmers Sàrl shall only be entitled to reimbursement of the Product, to the exclusion of any other form of compensation.
RIGHT OF WITHDRAWAL - REFUNDS AND RETURNS
When you return goods to us, you are responsible for the cost of postage. Please return the goods, well packaged, to the following address:

Please enclose a note stating your details (name, address, order number) and the reason why you wish to return the goods.
No reason" returns: you can return goods within 30 days of receipt. You can return products to us when they are complete, unopened, in their original, undamaged packaging, and in perfect condition for resale. We do not accept used or damaged products, or products whose original packaging has been damaged. We recommend that you pack the goods well before sending them to us, to prevent damage in transit. Please also state the exact reason for returning the goods and the following details: name, address, order number.
As soon as we receive your parcel - provided that everything is in order and that the return has been made within the 30-day period allowed - you will receive compensation. A refund of the corresponding amount will be made in the form corresponding to the method of payment you selected to place your order. The refund is made within a few days.
